DMCA Policy

Important Notice: ThumbNinja does not host, store, or upload any content. We provide a tool to access publicly available YouTube thumbnail URLs. All content accessed through our service is hosted by YouTube/Google.

1. Introduction

ThumbNinja respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid notices of alleged copyright infringement.

2. Our Role and Limitations

It is important to understand that ThumbNinja:

  • Does NOT host any images, videos, or content
  • Does NOT upload or store any thumbnails
  • Does NOT modify or alter any content
  • Only provides access to publicly available YouTube thumbnail URLs
  • Acts as a tool to retrieve publicly accessible information

All thumbnails are hosted by YouTube and are publicly accessible through standard YouTube URLs. Users are accessing content directly from YouTube's servers, not from ThumbNinja.

3. Copyright Ownership

All YouTube thumbnails accessed through ThumbNinja are the property of their respective copyright owners. ThumbNinja does not claim any ownership or rights to these images.

Users are responsible for:

  • Respecting copyright laws and intellectual property rights
  • Obtaining necessary permissions before using downloaded content
  • Using thumbnails only for lawful purposes
  • Understanding fair use principles and limitations

4. Filing a DMCA Notice

If you believe your copyrighted work has been accessed through our tool in a way that constitutes copyright infringement, please note:

  • The content is hosted by YouTube, not ThumbNinja
  • We recommend filing your DMCA complaint directly with YouTube/Google
  • Removing content from YouTube will automatically make it unavailable through our tool

4.1 DMCA Notice to ThumbNinja

If you still wish to send a DMCA notice to ThumbNinja, your notice must include the following information as required by 17 U.S.C. § 512(c)(3):

  1. Physical or electronic signature: A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
  2. Identification of the copyrighted work: Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the infringing material: Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (e.g., the YouTube video ID).
  4. Contact information: Your contact information, including your address, telephone number, and email address.
  5. Statement of good faith belief: A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

5. Counter-Notification

If you believe that your content was removed or access was disabled by mistake or misidentification, you may file a counter-notification with the following information:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located

6. Repeat Infringer Policy

We will terminate access for users who are repeat infringers of copyright in appropriate circumstances.

7. False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake may be subject to liability.

Do not make false claims. You may be liable for damages, including costs and attorney's fees, if you materially misrepresent that content is infringing your copyright.

8. YouTube's DMCA Process

Since all content is hosted by YouTube, we strongly recommend using YouTube's official DMCA process:

9. Fair Use

  • Teaching and education
  • Research and scholarship

10. Non-US Copyright Issues

If you are located outside the United States and believe your copyright has been infringed, please contact us with details of your complaint. We will review international copyright claims on a case-by-case basis.

11. Modifications to This Policy
